Acceptance of Terms and Conditions

By using our website and/or by purchasing an order (Online or via Return to School), it is deemed that you agree in full to the following terms and conditions.

Definitions

“The Photographer” or “we” means Heidi Bea Photography and it’s employees. “The Client” or “You/Your”  means any person, body of persons, firm or Company with whom the Photographer enters into a contract for the sale of goods or provision of services by the Photographer. 

Privacy

We will only use your details to create an account and to assist you with the purchase of images through our online shop and to keep you informed my email of photo deadlines and special offers. Each child's proofcard includes a unique password to enable access online to view and order their photographs. By using this platform, you agree to accept responsibility for maintaining the confidentiality of your password account and all activities that occur under it. 

Agreement to Payment methods

Online: Credit or Debit Card.

Online order payments are processed through our Stripe account, and you will be transferred to their secure pages to finalise payment. You can use Stripe to pay by credit/debit card even if you do not have a Stripe account of your own. The entire checkout process for Heidi Bea Photography website is held on a secure server using a verified SSL (secure socket layer) system for transferring data. 

Please note that as all items are produced to your specific order, payment will be charged to your card as soon as the order is placed, not at the point of dispatch.

Postage - All orders are subject to delivery via Royal Mail to your nominated delivery address. We aim to process and dispatch orders within a few days, to ensure the maximum level of quality in all processing, please allow a period of 7-28 days for delivery in Mainland Britain. For all International orders (all destinations outside of mainland Britain), please allow a period of 21-28 days. This includes all processing, framing, packaging and distribution. Please note we do not guarentee Pre Christmas delivery in the run up to the holiday season - We only guarentee to post your order within the time frame stated above although we endeavour to post these as soon as possible. Once the item is in the Royal Mail/Courier system the time frame for delivery is no longer controlled by Heidi Bea Photography.

Digital Downloads (Including Instant downloads)- We will endeavour to process your digital download order/s as soon as possible. Please download and save your images within 6 weeks of purchase or the link will be automatically disabled and your photos may no longer be available.

Refund Policy - Discretion of Management

Please choose carefully as Client refunds are not given on orders due to the custom personal nature of the product. This applies to both printed images and digital files (where available).  A digital download order is considered complete as soon as we receive notification that you have downloaded the images.

We are committed to offering only the highest quality. If you are not satisfied with the quality of your photo products, please feel free to get in touch.

Photo Effects/Self Cropping

No refunds will be given for any personal preference reasoning i.e. you have changed your mind regarding the final product or are unhappy with the colour effects or cropping you have chosen during the ordering process.

Copyright

In accordance with the Copyright, Designs and Patents Act 1988, the copyright of all images created by the photographer is owned by the photographer (which in this case is Heidi Bea Photography , unless Heidi Bea Photography has provided written authorisation to the contrary. As such, you are forbidden by law to copy, reproduce or manipulate the original image via editing in any way, particularly for commercial use or financial gain. 

If you have purchased a digital image/s the reproduction rights are strictly limited for the following use;

Personal re-printing, including to create photographic products and to share with family and friends as well as on social media. However, as before, this does not permit you to copy or manipulate the images in any way i.e. re-edit them or use them for commercial use and financial gain. 

The Client agrees to fully indemnify the Photographer in respect of any claims or damages or any costs arising in respect of claims for copyright violation made by a third party.

If the Client wishes to own the copyright of images created by the Photographer in full, an additional fee will be paid by the Client to the Photographer for transferring the copyright. This fee will be mutually agreed by both parties. The transfer of copyright will only become applicable after this payment has been made in full.

PLEASE NOTE: For Data Protection - Class/Group Photos are not available for digital download or on CD. In co-operation with each school, this is necessary in order to protect the individual children within the group photograph. As such, you are forbidden to circulate group/class images online.

Any Copyright infringement, will be subject to litigation.
